Dear Interested and Affected Party (I&AP)


On 19 June 2012, Chand notified all of the Interested and Affected Parties of the closure of the Clovelly Promenade Structure due to the unstable nature of the structure and its inability to withstand vehicle traffic and/or parking any longer.


The closure of the structure and the future works proposed were also discussed at the Community Liaison Meetings on 18 June 2012 and 20 August and mentioned in the July and September 2012 newsletters.


The proposed reconstruction of the promenade in order to make it safe for the public and prevent the possible collapse of the entire structure, triggers the National Environmental Management Act. Due to the urgency of the works required on the structure, a setback line adoption was applied for.


A application form was submitted to the Department of Environmental Affairs and Development Planning on 6 November 2012 requesting that a setback line be adopted in order for the works to proceed immediately without first undergoing an environmental impact assessment. The determination of the setback line was approved by the Department on 3 January 2013.


For those of you requiring more detail on the contents of the application form and background to the NEMA activities etc. please do contact Chand and we will endeavour to elaborate on this detailed process.


In this regard, we would like to inform you that as I&APs, should you wish to lodge an appeal against the adoption of the setback line which will enable the urgent reconstruction and stabilisation of the promenade structure to commence immediately, then you may do so in terms of the provisions contained in Chapter 7 of the NEMA EIA Regulations. The process is outlined in point number 9 of the attached letter from the Department of Environmental Affairs and Development Planning.
