Please accept my apologies for this urgent e-mail.  ONLY THIS MORNING, the e-mail below arrived in my Inbox.  The original application is on view in the office of Desiree Mentor (Sub-council – South Peninsula Manager) Fish Hoek Civic Centre Office adjacent to the Rates and Motor License Payments Department).  The office closes at 4 p.m. on week days.

 

If you are in favour of allowing this application for an Off-Premises Liquor Licence (i.e. a Bottle Store) to be granted, then ignore this mail.

 

However, If you are NOT in favour of allowing this application to be granted, please note that you NOW have only ONE DAY before objections will NO LONGER be accepted.

4 p.m. tomorrow afternoon (14th August) is the latest time by which objections can be lodged.  To be valid, your signed and dated letter, giving your contact details and stating your grounds for objection, should be handed in to the Sub Council’s office at the Fish Hoek Civic Centre (Reception).   Some grounds for objection are listed on the application form below – see items (a) to (e) and (i) to (V).

 

Historically Fish Hoek has been free of Bottle Stores.   If you’d like this state of affairs to continue, you’ve got one day in which to make your opinion heard.

Criteria for NOT granting licences *

31.(1)  The Liquor Licensing Tribunal or Presiding Officer, as the case may be, may not grant a licence, unless it or he or she is satisfied
on the balance or probabilities that –
(a)        the granting thereof is in the public interest;
(b)        the applicant is of good character, and not disqualified from holding a licence in terms of section 35;
(c)        the premises on which the sale or consumption of liquor will take place are or will upon completion be suitable for use by
the applicant for the purposes of the licence;
(d)        the applicant has the right to occupy the proposed licensed premises; and
(e)        the granting of the application does not prejudice –
(I)        the residents of a residential area;
(ii)         the residents of an institution for the aged or frail;
(iii)        the learners of an educational institution who are under the age of eighteen (18) years;
(iv)       the patients of an institution for drug or alcohol related dependencies; or
(v)        the congregants of a religious institution located in the vicinity of the proposed licensed premises.”
